Lusaka Town Clerk Alex Mwansa and Acting Director of Public Health Edgar Mulwanda have been set free from the Zambia Environmental Management Agency (ZEMA) Vs Lusaka City (LCC) Council garbage case.

The duo was set free when the case come up for ruling before Resident Magistrate Felix Kaoma at the Subordinate Courts in Lusaka today.

Magistrate Kaoma in his ruling set the duo free on the basis that the charge against them by ZEMA was defective in that the duo was not included in the initial Complaint lodged before the court.

Magistrate Kaoma observed that the complaint lodged before the court did not contain the names or the charges against the duo.

Therefore, Hon. Kaoma upheld the application by the advocates of the duo as they were wrongly summoned before the court as Mr Mwansa and Mr Mulwanda walked to freedom.

The duo was represented by Jeah Madaika of J&M Associates of Lusaka and LCC Director of Legal Services Ms Bibiana Bulaya.

On 24th August this year, the Zambia Management Agency (ZEMA) charged LCC for failure to comply fully with Site Restoration Orders issued on 1st August, 2018.

In addition, Mr Alex Mwansa and Mr Edgar Mulwanda were charged in their official capacities as Town Clerk and Director of Public Health at the Lusaka City Council respectively.
